Terms of Use
These terms govern your use of the Wick SMP website, Minecraft server and store (together, the "Services"), operated by Wick SMP. By joining the Server or using the Website you agree to them. If you do not agree, please do not use the Services.
1. Not affiliated with Mojang or Microsoft
Wick SMP is an independent community server. It is not an official Minecraft product and is not approved by or associated with Mojang Studios or Microsoft. "Minecraft" is a trademark of Mojang Synergies AB. You need your own legitimate copy of Minecraft: Java Edition, and your use of the game remains subject to the Minecraft EULA and Usage Guidelines.
2. Eligibility and accounts
You must be old enough to use Minecraft in your country. Store purchases have their own age requirement (see section 4). You are responsible for activity on your account and for keeping your Minecraft and Discord credentials secure.
3. Server rules
You must follow the rules published in the law channel on our Discord, which may be updated. In particular you may not: cheat or use unfair client modifications; exploit bugs or duplicate items; harass, threaten or discriminate against others; share illegal or sexual content; advertise other servers; attempt to attack, overload or gain unauthorised access to the Services; or evade a ban. Staff may warn, mute, kick, ban, roll back or remove items from accounts that break the rules, with or without notice where needed to protect the community.
4. Store, Coins and refunds
Our Store at store.wicksmp.com is run on the Tebex platform. Tebex Limited is the merchant of record: it takes your payment, handles taxes, chargebacks and refunds, and its Terms & Conditions apply to every purchase. You must be at least 16 to buy from the Store, and under 18 only with a parent or guardian's permission.
Coins and other Store items are optional, virtual, and have no cash value. Purchases are a licence to use digital virtual items in the game and, as set out in Tebex's terms, are final and non-refundable except where applicable consumer law requires otherwise. For example, buyers in the EU and UK have a statutory right to withdraw within 14 days unless they agree to immediate delivery and acknowledge that they lose that right once the digital content is delivered. Refund requests are handled under Tebex's refund policy and process. If something went wrong with a purchase, such as an item not delivered or a double charge, contact us first at contact@wicksmp.com or in the support channel on Discord and we will sort it out through Tebex.
Please do not open a chargeback or payment dispute without contacting us first. Items may be removed, and accounts restricted, if a purchase is reversed through a chargeback or fraud. Nothing here limits your statutory consumer rights.
5. Your content and our content
You keep ownership of what you build and write, and you give us a non-exclusive, royalty-free licence to host, display and show it on the Server, Discord and our promotional material (with credit where practical). The Website's design, name, logo and artwork belong to us or our licensors and may not be copied without permission.
6. Availability and changes
The Services are provided "as is" and "as available". We try to keep the Server running and your progress safe, but we do not guarantee uninterrupted service, and we may change, reset, pause or close any part of it. We make no promise that lost items or progress will be restored, except where the law requires.
7. Liability
To the extent permitted by law, we are not liable for indirect or consequential loss, or for loss of virtual items, progress or data. Our total liability for any claim relating to the Services is limited to the amount you paid us in the 12 months before the claim. Nothing in these terms excludes liability that cannot be excluded by law, including for death or personal injury caused by negligence or for fraud.
8. Termination
You may stop using the Services at any time. We may suspend or end your access for breach of these terms. Sections that by their nature should continue (for example 5, 7 and 9) survive termination.
9. Governing law and contact
These terms are governed by the laws of the State of California, United States, and the courts there have jurisdiction, without affecting any mandatory consumer rights you have in your home country.
